$2.44 Million Verdict
Nine men were injured and three killed in a foundry explosion in Springfield in 1999. Our client lost his life when an explosion in the shell molding department blew out walls and lifted part of the roof. After collecting all workers compensation benefits to which the children of our client were entitled, we pursued a claim against a third party. A lawsuit was filed on behalf of our client and other workers against the manufacturer of the resin, a product used at the foundry which becomes explosive when mixed with dust. The manufacturer was sued for product liability for essentially failing to provide an adequate warning on resin packaging.
The manufacturer settled and paid our client $2.44 million, even though the label on the packaging actually did provide notice of the explosive nature of the product, because Attorney Raipher D.
