Insurance Company Settles
Our client injured his wrist in a motor vehicle accident in Massachusetts. His injury required surgery on his ulna tendon and nerve. He is a pediatric orthodontist but after the motor vehicle collision, he had difficulty performing some types of surgery. After collecting the full amount of the insurance policy carried by the operator of the other car, Attorney Raipher D. Pellegrino made a claim on our client's behalf against his own automobile insurance company for underinsured benefits. Attorney Pellegrino demanded arbitration and our client was awarded more than $200,000 even though the amount of his medical bills were relatively small and his tax returns did not show much if any drop in his income after the accident.
After our client was paid the full amount of the arbitration award we filed a lawsuit against his insurance company pursuant to M.G.L. C. 93A/176D for failing to properly investigate the claim and make a reasonable over of settlement. The insurance company eventually settled and paid our client an additional settlement and our attorney's fees.
Result: The net award for all claims came to $215,974.05
