$1.275 Million - Aggravation of Injury
$1.275 Million Verdict for Aggravation Of Injury (One Of The Highest Jury Verdicts In The History Of Hampden County)
The plaintiff suffered severe injuries, including a fractured neck in an auto accident. Following his treatment at the hospital, he was sent to Health South Rehab for what was anticipated to be an extended period of rehabilitation. A week later, while being transported from Health South Rehab to a doctor's appointment, he suffered a dislocation of his fracture. Although there was no accident or immediate report filed, plaintiff Attorney Raipher D. Pellegrino was able to piece together the medical records and treatment to demonstrate the plaintiff's injuries were severely aggravated during the transport, resulting in increased pain, further impairment and other residual effects. Attorney Raipher D. Pellegrino sought out and retained a well-respected orthopedic surgeon as the Plaintiff's expert witness.
At the end of an extensive trial, the jury returned a verdict for the plaintiff for more $1 million dollars. The defendant company appealed and ultimately, after Attorney Raipher D. Pellegrino fought the appeal, settled and paid the plaintiff the verdict.
Result: Damages were awarded in the amount of $1 million for our client and $275,000 for his wife in her loss of consortium claim, plus interest for a total of $1.5 million.
