Surgical Errors and Informed Consent Attorneys in Boston and Springfield
Surgery, Surgical Errors and the Problem of Informed Consent
Medical malpractice attorneys in Massachusetts
Every surgery carries some risk, even plastic surgery. Anesthesia is risky for some people. A previously unknown medical condition may cause problems. The longer a surgical procedure takes, the more stressful it is on the body and the more likely there are to be complications.
Because of these risks, patients are required to sign an authorization stating that they have been informed of the risks and that they want to proceed with the surgery anyway.
Signing an informed consent form does not mean that you have waived your rights to sue if the doctor is negligent - although many doctors and hospitals make that argument. As a patient, you agreed to acceptable level of risk and did so with the expectation that the surgeon would follow accepted standards of care.
At the law office of Denner Pellegrino, L.L.P., we represent patients who have been hurt by surgical errors and the families whose loved ones died in surgery because of medical negligence. We investigate problem surgeries to get to the facts. If you think your family has been affected by medical malpractice, contact us online. Or, call toll free at 866-348-0900 to speak with a lawyer in one of our offices in Boston or Springfield, Massachusetts.
Was your consent really informed?
Most authorizations are signed while patients are lying on tables in pre-op and about to receive a sedative. If that was the first time you were told of the risks of surgery, that is a problem. You should have discussed both the benefits and the risks of any elective surgery well beforehand. For example, gastric bypass surgery is very risky, and even Lasik surgery can be unacceptably risky if your particular eye problem is not a good candidate for improvement.
Simply signing a form does not mean you have given informed consent. Did you understand the risks? Did you understand the nature of the complications you might experience? Informed consent is one area of law that is different in Massachusetts than in other states. An attorney can explain this to you at our office.
