Not Guilty Of Vehicular Manslaughter
Father Of Twelve Found Not Guilty
Attorney Raipher D. Pellegrino defended a father of twelve who was accused of vehicular homicide, leaving the scene after causing death and other offenses. He was driving his truck over a very dark country road and hit a young man resulting in his death. Later that evening, the defendant was arrested after his car was discovered at his home about 25 miles from the scene of the accident. The news media carried the story for an extended period and our client was portrayed very negatively. Attorney Raipher D. Pellegrino reviewed the discovery provided by the District Attorney's office and determined to follow the same investigative avenues that the prosecution normally would have pursued. Attorney Raipher Pellegrino realized the Commonwealth had withheld potentially exculpatory evidence that could show that the defendant was innocent. Attorney Raipher D. Pellegrino moved for a mistrial or that the Commonwealth produce the information sought and for the trial to be suspended. This would enable Attorney Raipher D. Pellegrino to investigate the newly discovered evidence. His motion was successful and the trial was suspended. When the trial resumed, Attorney Raipher D. Pellegrino was able to effectively cross-examine the Commonwealth's witnesses and call defense witnesses that resulted in the jury finding the defendant not guilty of motor vehicle homicide. The results of his investigation gave information to the jury that, under cross-examination of a witness, resulted in a finding of new evidence not uncovered by the police.
Result: After a nearly two week trial, our client was found not guilty of vehicular manslaughter.
